10 November 2020

* As a result of the grounding it is reported that Owners entered into a Lloyd's Open Form 2020 (LOF 2020) with professional salvors to assist in refloating the vessel which was successfully completed on 8th November 2020.

* Salvage security will now be required from a source in the UK and WKW will be able to assist subject to our usual terms and conditions. Security provided by WKW is acceptable to the Council of Lloyds and widely preferred by professional Salvors.

* Furthermore, in view of the extraordinary expenditure incurred / still to be incurred by the Owners, they have also declared General Average. As such, acceptable GA security will be also required to be issued.

* Cargo and containers will be held at the Port of Tripoli and shall only be released for delivery / on-forwarding to destination once both acceptable Salvage and General Average security has been issued.

* As a result of the grounding the vessel is reported to have suffered damage to its hull and also water ingress into the engine room.

* WKW will also be able to assist with investigations into the casualty with consideration to any recovery claim including but not limited to salvage indemnity claim.

* Should you insure any cargo onboard this vessel we recommend you contact us as soon as possible in order we can immediately take steps to protect your interests.

2 November 2020

* It is reported that the Owner of the MSF LADY HALOUM entered into a Lloyd's Open Form (LOF) Salvage Agreement with professional salvors to assist in refloating the vessel.

* As a result of the LOF, salvage security will be required to be provided by the cargo on board to facilitate its on-carriage and delivery.

* It is also possible that this casualty may give rise to a declaration of general average in which case additional general average security will be required.

* WKW is well placed to be assist in the provision of salvage and general average security in accordance with our standard terms, our guarantees being acceptable to Salvors, the Council or Lloyd's and Average Adjusters.

* Should you Insure any cargo on board this vessel and require our assistance we would recommend that you contact us as soon as possible in order that we may take immediate steps to protect your interests.

* We have received the following further information regarding the grounding of fully cellular container vessel, MSF LADY HALOUM:

* It is reported that the vessel is in sound condition but remained aground on the breakwater of the Tripoli port, as at 28 October 2020.

* Port Authorities are reported to have called for additional tug assistance to be provided to assist to refloat the vessel.

* Since salvage services are not currently being provided by professional salvors, it is unlikely that Salvage security will be required to be provided by cargo interests at this time.

* However, it is possible that shipowners will declare GA, especially if cargo requires to be lightered from the vessel to assist the salvage operation.

* In that case, General Average security may be required from all Cargo Interests prior to the delivery of their cargo and we may be able to assist in that regard.

* We therefore suggest that you contact us urgently if you insure any cargo stowed on board this vessel so that we can immediately start taking steps to protect your interests.

* We have received reports that fully cellular container vessel, MSF LADY HALOUM, dragged its anchor and ran aground on the outer breakwater of Tripoli port, Libya during a storm on 27 October 2020.

* A tug has been deployed to assist to refloat the vessel but it is currently not clear whether additional resources will be required to successfully refloat the vessel.

* If salvage services are required to be provided by professional salvors, Salvage Security may be demanded from a source in the UK and W K Webster may be able to assist. Security provided by WKW is acceptable to the Council of Lloyds and widely preferred by professional Salvors.

* Owners may also declare General Average. If so, General Average security may be required from all Cargo Interests prior to the delivery of their cargo and we are also likely to be able to assist in that regard.

* It is also possible that recovery issues may arise in respect of any loss or damage to cargo; any salvage indemnity that may be demanded of cargo interests; and defence of any claims in GA.

* We therefore recommend that you contact us urgently if you are concerned with any cargo on board this vessel so that we can immediately start taking steps to protect your interests.
