* We have received reports that fully cellular container vessel, COSCO NAGOYA has had an incident resulting in the loss of containers overboard and also collapsed on deck during its passage from Busan shortly after 23 November 2021.

* We understand that the vessel has interrupted its voyage to Long Beach to deal with the situation and the vessel is currently off Gwangyang Port, South Korea as a port of refuge. Early indications are that this may have been quite a serious incident.

*It is not yet clear when the vessel's voyage will resume or whether containers will need to be removed, restowed or transhipped. Inevitably, recovery issues will arise in respect of loss and damage to cargo, and also in respect of delay, particularly where time sensitive or temperature controlled goods are concerned.

* It is also possible that this incident may give rise to General Average, although that remains unclear at present.

* We are already instructed by certain cargo interests and we are taking steps to appoint surveyors and experts to assist in investigations both into the cause of the casualty and the extent of the losses suffered.

* We recommend that you contact us urgently if you are concerned with any cargo on board this vessel so that we can immediately start taking steps to protect your interests.
